With the death of Justice Ruth Bader Ginsburg, President Trump has the opportunity to fill her seat with a more conservative justice. Some of the left are very upset about this. But pundits know that that is the president’s prerogative, whoever serves in the White House. Much of the controversy boils down to the fact that different Supreme Court justices have very different philosophies of jurisprudence. Some want to strictly follow the Constitution; others see the document as a “living, breathing document,” from which they can create all sorts of “rights,” not remotely to be found in the Constitution. Zach Smith, who serves at the Heritage Foundation as a Legal Fellow, joins Jerry Newcombe on Vocal Point to discuss President Trump and the SCOTUS vacancy and the controversy. www.heritage.org
